Benzema is alleged to have played a part in the suspected blackmail and sex tape scandal involving fellow France international Mathieu Valbuena.
The former Lyon forward was arrested in the investigation in November 2015 before being subsequently released and charged.
And an appeal to have the case thrown out over claims that police used “dishonest” methods to obtain evidence has been rejected by the court.
"We are pretty astonished because the decision is to reject our requests for the investigation to be cancelled," representative Serge Money said.
The court has also recommended that the magistrate considers charging former Liverpool striker Djibril Cisse for his alleged part in the same case.
Cisse has denied any wrongdoing when questioned on the issue in a television interview in 2015: “I never swindled anyone - Mathieu is a friend".
